Arizona Health Insurance Laws and Regulations

Arizona residents are protected under a few different laws as they shop and purchase individual health insurance.

Those who are looking for an individual plan after they have left a group plan with an employer are protected under the federal law HIPAA. In general, this law prohibits Arizona health insurance companies from imposing a waiting period for pre-existing health conditions.

Residents also have the right to temporary continued health coverage from a previous employer under the federal law COBRA.

Once accepted into a health plan, Arizona state law prohibits insurers from canceling coverage if the policyholder became sick or was injured.

The following medical services are required to be covered under the Arizona health insurance law.

  • Screening for breast cancer
  • Care for some diabetes-related conditions
  • Continuity of health care for pregnant women
  • Contraceptives

Also, small groups of 2 to 50 people are guaranteed to be accepted for Arizona health insurance coverage under state law.

Arizona Health Insurance High Risk Pools

The Patient Protection and Affordable Care Act set up temporary national high risk pools to provide people with pre-existing conditions health insurance coverage.

The Pre-Existing Condition Insurance Plan (PCIP) in Arizona will require enrollees to pay monthly premiums and out-of-pocket expenses like normal Arizona health insurance plans.

Residents with PCIP will pay around the same amount that people without pre-existing conditions pay in the private insurance market. The estimated monthly premiums for Arizona residents are $323 for ages 0 to 34; $387 for ages 35 to 44; $495 for ages 45 to 54; and $688 for ages 55 and older.

Individuals will be able to receive health insurance coverage for physician and hospital visits, prescription drug coverage, behavioral health services, emergency visits and surgeries and more.

People are eligible for the Arizona PCIP plan if they are United States citizens, have been denied health insurance coverage for a pre-existing condition and have been uninsured for six months.
