Alaska Health Insurance Laws and Regulations

All states have their own laws that govern the individual health insurance market. Here are a few of the laws and regulations in Alaska.

Alaska health insurance plans are guaranteed renewable. That means Alaska health insurance companies cannot cancel coverage because a policyholder was injured or became sick.

Alaska state law requires all individual health plan cover certain medical services. Here are the required services:

  • Screening for breast, cervical, prostate and colorectal cancer
  • Continuity of care for pregnant women
  • Care for some diabetes-related conditions
  • Hearing aids for children

The state also has a high-risk health insurance pool for individuals who cannot find coverage because of a pre-existing health condition. Residents can get insurance from this pool, the Alaska Comprehensive Health Insurance Association, if:

  • They are uninsured.
  • They are HIPAA-eligible.
  • They have been denied coverage.
  • They have been diagnosed with a serious health condition such as cancer, diabetes or AIDS.
  • They were accepted for a plan, but that policy had many coverage exclusions.

Alaska residents are also protected under the federal laws COBRA and HIPAA.

COBRA gives citizens the right to continue coverage from a former employer for a temporary period of time. HIPAA prohibits insurers from imposing coverage exclusion or waiting periods on residents purchasing an individual Alaska health insurance policy after leaving an employer's group plan.

Alaska Health Insurance Public Programs

  • Medicaid

Alaska Health Insurance High Risk Pools

The Patient Protection and Affordable Care Act set up temporary high risk pools to provide individuals with medical conditions health insurance coverage.

The Pre-Existing Condition Insurance Plan (PCIP) will require enrollees to pay monthly premiums and out-of-pocket costs like normal Alaska health insurance plans.

Alaska residents with PCIP will basically pay the same amount that people without pre-existing conditions pay. The estimated monthly premiums rates for Alaska residents are between $434 and $1,735 a month. The deductible that an individual must meet before the PCIP will pay for benefits is $1,500 with a $3,000 out-of-pocket limit.

Individuals are eligible for the Alaska PCIP if they are a United States citizen, have been without health insurance for six months and have a pre-existing condition.

Benefits from the high risk pool will include primary and specialty health care, hospital visits and prescription medications.
