Delaware Health Insurance Laws and Regulations
Under Delaware health insurance law, all health plans are guaranteed renewable. That means no Delaware health insurance company can cancel coverage because the policyholder became sick or was injured.
If a Delaware resident is looking for an individual health plan after being covered by an employer's group plan, they also may be protected under the federal laws HIPAA and COBRA.
HIPAA ensures a new individual plan will not impose coverage waiting or exclusion periods for pre-existing health conditions. COBRA guarantees an employee the right to continue their current group coverage for a limited period of time after they leave their employer's plan.
