Georgia Health Insurance Laws and Regulations

In Georgia, residents are protected by federal laws COBRA and HIPAA if they are searching for an individual Georgia health insurance plan after leaving an employer's group coverage.

COBRA gives former employees the right to stay on their employer's group insurance coverage for a temporary period after their employment ends.

Under HIPAA, Georgia health insurance companies are not allowed to impose waiting periods or exclusion periods for pre-existing health conditions. Georgia health insurance law also requires that all HIPAA-eligible residents have guaranteed access to a health plan.

In addition, state law requires that all Georgia health insurance plans provide coverage for the following medical services:

  • Care for children's clinical trials for anyone diagnosed with cancer before turning 19 years old
  • Screening for breast, colorectal, cervical, prostate, and ovarian cancer
  • Certain diabetes treatments
  • Vaccinations for children

  • Medicaid

Georgia Health Insurance High Risk Pool

The Patient Protection and Affordable Care Act established temporary high risk pools to provide health insurance to people with pre-existing conditions.

The Pre-Existing Condition Insurance Plan (PCIP) in Georgia will require enrollees to pay monthly premiums and out-of-pocket expenses similar to regular Georgia health insurance plans.

Enrollees in the Georgia PCIP will have to pay around the same amount that people without pre-existing conditions pay for health insurance. The estimated monthly premiums for Georgia are $323 for ages 0 to 34; $387 for ages 35 to 44; $495 for ages 45 to 54; and $688 for ages 55 and older. In Georgia, there will also be a $2,500 deductible for covered medical expenses with an out-of-pocket limit set at $5,950.

Georgia enrollees with have health insurance coverage for physician and hospital visits, emergency services, prescription drug coverage and more.

Individuals are eligible to enroll in Georgia PCIP if they are a United States citizen, have a pre-existing condition and have been uninsured for six months.
