Illinois Health Insurance Laws and Regulations
There are several Illinois health insurance laws and regulations that protect policyholders living in the state.
All Illinois health insurance plans under state laws must cover certain medical care services. Those medical services include:
- Screening for breast, cervical, colorectal, and prostate cancer
- Certain diabetes-related care
- Continuity of care for pregnant women
Illinois health insurance law also requires mental health parity, which means mental health conditions must have the same coverage limits and maximums as physical conditions.
In addition, state law requires all Illinois health insurance plans to be guaranteed renewable no policy can be cancelled because a policyholder ages or becomes sick. For managed care Illinois health insurance plans such as HMOs and PPOs, however, residents must stay in their service area to have guaranteed renewable coverage.
Illinois policyholders can also be protected under the federal laws HIPAA and COBRA.
Illinois Public Health Insurance Programs
There are a few different public Illinois health insurance programs to assist low-income residents in getting access to insurance coverage and health care. These programs include:
- Medicaid

- Illinois Comprehensive Health Insurance Plan (CHIP)

- Illinois Breast and Cervical Cancer Program

Illinois Health Insurance High Risk Pools
The Patient Protection and Affordable Care Act established temporary national high risk pools to provide health insurance to those with pre-existing conditions. Illinois Legislature has formed the Illinois Pre-Existing Condition Insurance Plan (IPXP) for residents.
The IPXP is not a public program and enrollees will pay monthly premiums and out-of-pocket costs similar to normal Illinois health insurance plans.
Recipients of IPXP will pay around the same amount that people without pre-existing conditions pay on the private insurance market. Recipients cannot pay more based on gender ratings but may pay more due to age, geographic location and tobacco use.
People are eligible to enroll in the Illinois Pre-Existing Condition Insurance Plan if they are a United States citizen, have been uninsured for six months and have a medical condition.
Illinois Comprehensive Health Insurance Plan (ICHIP) is the existing Illinois health insurance high risk pool. ICHIP is more expensive than IPXP but residents are urged not to drop ICHIP coverage and apply for IPXP.
