Michigan Health Insurance Laws and Regulations

There are a few different Michigan health insurance laws that affect how residents can get coverage.

Residents are guaranteed to be able to purchase a Michigan health insurance plan through Blue Cross Blue Shield of Michigan. BCBS of Michigan also cannot raise your insurance premiums because of a health condition.

Other Michigan health insurance companies may exclude coverage or deny applications based on health history or pre-existing health conditions.

Residents are also guaranteed to be able to obtain coverage through any individual HMO (Health Maintenance Organization) plan in Michigan during a 30-day open enrollment period. Visit the Michigan Office of Financial and Insurance Regulation online to learn more about HMOs in Michigan.

Small groups in Michigan with 2 to 50 people are guaranteed to be able to obtain health coverage, as well.

Michigan health insurance law also requires all individual health plans cover certain medical services. These services include:

  • Screening for breast cancer
  • Care for some diabetes-related conditions
  • Continuity of care for pregnant women

Individual plans are also guaranteed renewable in the state, which means Michigan health insurance companies cannot cancel coverage because of health conditions.

Under the federal law COBRA, eligible Michigan residents have the right to keep their group coverage after they leave a job that provides health benefits. The federal law HIPAA also provides protection to individuals when they leave a group health plan.
