Nebraska Health Insurance Laws and Regulations

Nebraska health insurance laws regulate the private health insurance market in the state. Some federal laws also protect Nebraska residents as they search for individual health plans.

All Nebraska health insurance plans are required to cover certain medical care services. They include:

  • Mammograms and screening for colorectal cancer
  • Diabetes care
  • Vaccinations for children

Nebraska health insurance plans also must provide equal coverage for mental health conditions and physical conditions.

Residents who have recently left an employer's group health plan can be protected under two federal laws, HIPAA and COBRA. Under HIPAA, insurance companies are not allowed to impose coverage exclusion or waiting periods. Under COBRA, former employees have a right to continue their group coverage for a temporary period of time.

Nebraska also has a high-risk health insurance pool. The pool, known as the Nebraska Comprehensive Health Insurance Pool, provides Nebraska health insurance for residents who are unable to find affordable coverage because of a pre-existing condition.

The public Nebraska health insurance assistance programs help low-income residents get access to health insurance and health care. The programs include:

  • Medicaid

Nebraska Health Insurance High Risk Pool

Residents in Nebraska with pre-existing conditions will be able to get health insurance coverage from the temporary high risk pools set up by the Patient Protection and Affordable Care Act.

The Pre-Existing Condition Insurance Plan (PCIP) in Nebraska will work similar to regular Nebraska health insurance policies. The plan will require enrollees to pay affordable monthly premiums and out-of-pocket costs.

Those eligible for the Nebraska PCIP will pay around the same amount as people without medical conditions pay for health insurance. The estimated monthly premium costs for Nebraska enrollees will be $307 for ages 0 to 34; $369 for ages 35 to 44; $471 for ages 45 to 54; $655 for ages 55 and older. The plan has a deductible of $2,500 a year, which must be met before health insurance benefits kick in. There is also an out-of-pocket limit set at $5,950 a year.

Nebraska residents with medical conditions will have health insurance coverage for prescription drugs, hospital and doctor visits, emergency services and more.

Individuals may apply for the Nebraska PCIP program if they have a pre-existing condition, have been without health insurance for six months and are a United States citizen.
