New Mexico Health Insurance Laws and Regulations

New Mexico health insurance law requires all health plans to provide coverage for certain medical services including:

  • Patient care costs in clinical cancer trials
  • Screening for breast, cervical, and colorectal cancer, along with HPV screening
  • Diabetes care
  • Vaccinations for children
  • Contraceptives, if a health plan covers prescription drugs

New Mexico health insurance state law also requires mental health conditions to be covered equally as physical health conditions.

Generally, New Mexico health insurance companies are allowed to accept applicants and set premiums based on health status and pre-existing health conditions. But some individuals are protected if they are HIPAA-eligible.

Under the federal law HIPAA, some individuals who recently left a group health plan with an employer are guaranteed to be issued coverage in the private market.

For individuals who are turned down for New Mexico health insurance coverage or cannot find a reasonably priced plan because of a pre-existing condition, they can obtain coverage through the state's high-risk health insurance pool.

The high-risk pool, called the New Mexico Medical Insurance Pool, provides comprehensive health benefits and a choice of deductibles. Remember, premiums are typically expensive in a high-risk pool.

New Mexico Health Insurance High Risk Pool

Residents in New Mexico with medical conditions will be able to get health insurance from a high risk pool established by the Patient Protection and Affordable Care Act.

New Mexico Medical Insurance Pool (NMMIP) will run similar to regular New Mexico health insurance plans. The plans will require enrollees to pay affordable premiums and out-of-pocket costs.

Enrollees in the NMMIP will pay around the same amount that people without medical conditions pay for health insurance. The estimated premiums for New Mexico residents range from $183 to $526 a month. There are 3 different plans to choose from with deductibles ranging from $500 to $2,000. The deductible must be met before health insurance benefits kick in. The out-of-pocket limit ranges from $2,500 to $3,500 for health care services.

People in New Mexico with pre-existing conditions will have coverage for prescription drugs, doctor and hospital visits, emergency services and more.

Individuals may apply for the New Mexico program if they are a United States citizen, have a pre-existing condition and have been without health insurance for six months.
